6. Your responsibilities when texting families
Our Service enables you to send SMS messages to parents and prospective families. By using this feature, you acknowledge and agree to:
- Obtain prior express written consent from each recipient before sending any SMS marketing messages, as required by the Telephone Consumer Protection Act (TCPA)
- Maintain records of consent for each recipient
- Honor all opt-out requests immediately and maintain a suppression list
- Include opt-out instructions in all marketing messages (e.g., "Reply STOP to unsubscribe")
- Comply with all applicable federal, state, and local telecommunications regulations
- Not use auto-dialing features to contact numbers on the National Do Not Call Registry without prior consent
You are solely responsible for ensuring your SMS communications comply with TCPA and all applicable regulations. Child Care Genius provides the technology platform but does not verify compliance of individual messages.
7. Voice Recording and AI Receptionist
Our Service includes an AI-powered voice receptionist feature ("Genius Line") that may record telephone calls. By using this feature:
- You agree to comply with all applicable federal and state wiretapping and call recording laws
- You acknowledge that some states require all-party consent for call recording — you are responsible for ensuring callers are notified that calls may be recorded
- The AI receptionist will inform callers that the call may be recorded at the start of each conversation
- Recorded calls and transcripts are stored securely and accessible only to authorized users within your organization
- You will not use recorded calls for purposes other than childcare business operations
- Voicemail recordings captured as fallback are treated with the same security as call recordings
8. Children's Data (COPPA Compliance)
Our Service is designed for use by childcare business operators, not by children. However, the platform stores information about children as part of enrollment management. Regarding children's data:
- We do not knowingly collect personal information directly from children under 13
- All children's information is provided by their parents, guardians, or authorized childcare staff
- You are responsible for obtaining parental consent before entering children's data into the platform, as required by the Children's Online Privacy Protection Act (COPPA)
- Children's data is protected by the same security measures as all other data and is only accessible to authorized users within your organization
- Upon request, parents may access, correct, or request deletion of their child's data through their childcare center
9. Payment Processing
Our Service may integrate with third-party payment processors for enrollment fees, waitlist deposits, and tuition payments. Regarding payments:
- Payment processing is handled by PCI-compliant third-party providers (e.g., Stripe)
- We do not store complete credit card numbers or sensitive payment credentials on our servers
- You are responsible for setting accurate pricing and refund policies for your services
- Transaction fees from payment processors are separate from our Service subscription fees
- Refund disputes should be handled directly with the applicable payment processor
10. Data and Privacy
Your use of the Service is also governed by our Privacy Policy. You are responsible for ensuring that your use of the Service to collect, store, and process personal data complies with applicable privacy laws, including obtaining necessary consents from parents and guardians whose information you enter into the platform.
11. Usage Limits
Each subscription plan includes monthly usage limits for certain features:
- SMS messages sent per month
- Emails sent per month
- AI voice receptionist minutes per month
- AI-powered features (lead scoring, content generation) per month
Exceeding your plan limits may result in temporary suspension of the affected feature until the next billing cycle or until you upgrade your plan.
12. Intellectual Property
The Service and its original content, features, and functionality are owned by Child Care Genius and are protected by international copyright, trademark, and other intellectual property laws. You retain ownership of the data you input into the Service.
13. Subscription and Billing
Some features of the Service require a paid subscription. By subscribing, you agree to:
- Pay all fees associated with your subscription plan
- Provide accurate billing information
- Authorize automatic renewal unless cancelled before the renewal date
14. 90-Day More Tours Guarantee
The 90-Day More Tours Guarantee promises that if you do not convert a higher percentage of leads to tours during your first 90 days on Genius Enrollment Machine ("GEM") than you did in the 90 days before GEM, we will refund every dollar you paid during that period and give you another 90 days on the platform at no charge. To qualify, you must meet all of the following conditions:
- Lock in your baseline at signup by providing the number of leads and tours from your 90 days prior to GEM, and provide documented proof of that lead-to-tour conversion rate (export from your prior CRM, dated screenshots, or equivalent records) when you submit a claim
- Show proof that you have cancelled any previous CRM, lead-management, or enrollment platform and are running solely on GEM for the entire 90-day guarantee period. You have to be all in. Running GEM alongside another system disqualifies the guarantee, because we cannot prove GEM caused the result if leads or follow-ups are being handled outside of it. Acceptable proof includes a cancellation confirmation email, a final invoice, or a screenshot of the cancelled subscription from your prior provider, dated on or before your GEM go-live date
- Have your GEM lead form live on your website so that all new inquiries flow through the system
- Activate at least one automated follow-up sequence in GEM
- Attend your onboarding setup call
- Attend at least 3 GEM Labs during the 90-day window so our team can help you improve if results are off-track
- Claim within your eligible window — the 90 days begins once GEM is set up and live on your website, and the guarantee is available for the first 6 months of usage
Brand new centers with no 90-day enrollment history qualify under a tour-count floor agreed at onboarding; all other conditions above, including the requirement to run solely on GEM, still apply. Refunds cover subscription fees paid during the guarantee period. One claim per organization. Child Care Genius reserves the right to deny claims where conditions are not met or where the documentation provided is incomplete or inconsistent.
15. Cancellation and Termination
You may cancel your subscription at any time through your account settings. We may terminate or suspend your account immediately, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties. Upon termination, your data will be retained for 30 days before permanent deletion, unless required by law to retain it longer.
16. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.
17. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, CHILD CARE GENIUS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES.
18. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify you of significant changes by posting the new Terms on this page and updating the "Last updated" date. Your continued use of the Service after changes constitutes acceptance of the modified Terms.
